Estate planning ensures that the maximum amount of a person's assets are preserved and smoothly transferred in the event of incapacity or death. For most, a will is the most effective estate planning tool, and having a will greatly reduces the burden of administrating the estate after death. In some situations, appropriate trusts can also be used to minimize taxes and maximize estate value.
From entity formation to contract drafting and review, attorneys drive value for businesses in several ways. Reducing exposure to legal liability is often the first to come to mind, but attorneys also help ensure that the contracts through which a business operates are drafted to take advantage of every opportunity to increase profits and protect against unexpected shocks.
Probate is the process by which a purported will is "proved" in court to be the valid will of the deceased. Once a will is probated, the executor may begin administering the estate by paying creditors and distributing assets to the heirs. An attorney guides the client through the probate process, advising which courses of action are most efficient and will best preserve the value of the estate.
John O. Scott is an attorney licensed to practice law in Texas. He is a graduate of both The University of Texas School of Law and Texas A&M University. After working as a corporate finance and transactional attorney in the Metroplex, he and his family decided to move a few hours west to the area where he is from and where his family still farms and ranches. His wife, Amanda, is a CPA, and they live near Abilene with their two children, Laura and James.
